Can a California Condo Change the Roof Without Owner Approval?

Question:

Can the HOA Board change the roof style without Owner’s vote/conscent?
The HOA condos I live in wants to change spanish tile to asphalt shingles. This changes the style of the architecture as we have the spanish stucco design as well.

Answer:

Hi Christine,

It depends on your governing documents. Generally, owners need approval from the board or architectural committee prior to making any architectural changes. But, the reverse isn’t always required. Check your CC&Rs if your board is acting within its authority.
