Question:
I have heard from an HOA member that a homeowner can remove a tree, even if it is not sick, and that tree will not have to be replaced. I want to be sure that’s correct before I make a change on my own property.
Thank you!

Answer:
Hi Rich,
It really depends on your association’s governing documents. Every HOA has a different set of rules, so referring to your governing documents is recommended. It is best not to rely on hearsay. Instead, make sure to review your HOA’s CC&Rs, bylaws, and rules to confirm whether or not you can remove a tree without replacing it. More often than not, members need permission from the association to remove a tree. It is also a good idea to talk to your HOA board or HOA manager about this.
