Question:
I’m in a Gated Community and the HOA states streets are owned by the HOA and are not public streets. The C&R supposedly state that no one can park on the street. Is this legal in Texas and how do large households get around this?

Answer:
Hi Robert,
Yes, an HOA can restrict parking on private streets (streets owned by the HOA). As a homeowner, you entered an agreement with the HOA when you bought a home in the community. As such, you must follow the rules of the association, including parking rules.
