I had purchased a home that falls under HOA rules. Once I moved, I moved my family (Dad, Mom & Siblings) in the home. They have lived in their over six years and now that my HOA is under a new reign, they want to charge me Tenant fee’s. I do not have a rental contract because my family live in my home. Is their a Virginia statute that state’s if I don’t live there, my family has to pay rental fees? The other thought I had was to add my dad to my deed then they would have to leave me alone correct? It is important to check your association’s governing documents to see if it can charge a tenant’s fee for letting your family live in your home. You can certainly add your father to the deed to avoid future problems, though it would be best to consult an attorney and have them read through the HOA’s governing documents as well.
