Can an HOA in Georgia Levy Fines If Covenants Don’t Say So?

Question:

We are a POA in North Georgia. We are not governed by the Georgia HOA rules .

How do we enforce covenant violations? We have nothing in our covenants that states a fine can be levied. The only thing we can lien is if the dues or assessments are not paid.

What is a good way of bringing violations to the individual home/property owner?

Hi Chuck,

If your governing documents don’t give your HOA the authority to levy fines, consider amending them. Section 44-3-226 of the Georgia POA Act provides guidance on how you can amend your documents. Your own governing documents may also contain additional procedures concerning amendments.
