Can an HOA Require Owners to Plant Trees?

Question:

Can an HOA demand that you plant trees? Our front yard is small and the roots from trees would eventually damage the irrigation system, the water pipes and sewer. This has already happened to our neighbor.

Answer:

Hi Roslyn,

You should check your association’s governing documents to see if it has the authority to require owners to plant trees. It is worth noting, though, that landscaping and yard maintenances are common obligations or requirements for homeowners in HOA communities. If you believe the trees will have a detrimental impact on your irrigation system, consider bringing up the issue with your HOA board.
