Can an HOA Use Venmo to Collect Dues?

Question:

My HOA is using a non-Board member’s Venmo account to collect dues. Where can I find the law on this issue? I can’t imagine this is okay. If a Venmo account is collecting money and transferring into the bank account of the HOA, that means that the person’s Venmo can access the HOA’s bank account.

Your HOA’s governing documents should indicate the proper and required way to collect dues. If money transfers or electronic payments through apps are allowed, then your association can use Venmo as a collection method. It is possible that the Venmo account being used is under the control of your management company, which is why it is not under a board member’s name. If you are uncomfortable with this setup, approach your board or manager to share your concerns.
