Can Condo President Remove a Board Member in Florida?

Question:

Does Florida Law permit the president of a condominium board to remove a director because they neglected to submit in writing prior to their annual meeting their intention to remain on the condo board for another year?

Answer:

Hi Keith,

It depends on your bylaws. Your bylaws should be able to tell you the powers of the HOA president, including whether or not they have the authority to remove a board member based on the reason you stated. That being said, removing a board member in Florida generally requires more than just a single person’s decision or vote. It is important that your HOA board follows the requirements and procedures outlined within the governing documents, specifically your bylaws, to remove a board member.
