Can HOA Regulate Parking on Public Roads in Alabama?

Question:

My HOA has a covenant restricting street parking. My son purchased a car that cannot be parked in the driveway because it is too low and the steep entry into our driveway will cause damage. The streets are not owned by the development and are under the city’s jurisdiction, which allows street parking. Can I legally dispute this covenant? How might I resolve this issue?

Hi David,

An HOA generally does not have authority over public streets unless it has some sort of agreement with the local government. Talk to your HOA board about the rule and ask them how it’s valid. It is always best to communicate with your board or HOA manager first.
