Can HOA Restrict Visitors on a Private Road?

I have a HOA that has 14 houses in the community. The community is on a private road that is maintained by the HOA. There is various people who do not live in the community walking on the private road. They claim to have permission from one of the residents. Can the HOA overrule the resident’s approval and have they subjects trespassed or removed?

Hi Billy,

It depends on your association’s CC&Rs. If your CC&Rs dictate that the HOA has the ability to restrict visitors from using the private road, then it can generally do so. You may also want to implement visitor passes to exercise more control, provided your documents permit it.
