Can HOAs Publish Delinquent Owners’ Names

In Ohio, is it legal for HOA to release list of names of people who have not paid their annual fees?

If by-laws state or assume an annual audit, but board members refuse to schedule an audit, can homeowners force it, if so, how?

There is currently no law in Ohio that prohibits or allows publishing the names of delinquent owners. You may refer to your association’s governing documents to see if this is permitted. Additionally, it is wise to consult a lawyer for further guidance.

As for the audit, depending on your governing documents, homeowners may be able to demand an audit. Look for guidelines in your bylaws or CC&Rs that talk about how the members in your HOA can do this. It may require scheduling a special meeting with a vote of the owners. If the board still refuses, you may want to consult a lawyer to know what action to take next.
