Can Homeowners Enforce Rules in Virginia?

I am purchasing a home in Virginia with a CCR but no HOA to enforce. There are many violations of the CCR throughout the neighborhood. Can a homeowner attempt to enforce the CCR on me if other neighbors are violating the rules. How does this work?

Hi Richard,

It is the job of the HOA to enforce the covenants in the community. Homeowners individually do not have the ability to enforce the rules. If you wish to enforce them, I would suggest running for the HOA board. If there is no HOA at all or was dissolved, then the rules may no longer be applicable. It’s best to check with an attorney for further guidance on this matter.
