Our subdivision, which has no HOA, wants to form an HOA. Can they force me to join? Can they subject me to the rules of the HOA if I am not a member?

In most HOAs, membership is mandatory. However, since your subdivision is just now starting an HOA, they cannot force you to become a member if there is no pre-existing binding agreement.
