Question:
Can a HOA board take it upon themselves to use homeowners dues todonate to charities?
– Denice
Answer:
Hi Denice,
Michigan law currently does not address this. That being said, you should check your association’s governing documents. You might find provisions in there that state what the board can and can’t do with homeowner dues. In general, if the board cannot justify the donation, then it should not make it. Dues are designed to pay for the community’s expenses. Remember that board members have a responsibility to make decisions that are in the best interests of the community.
