Can the HOA Remove a Tree in California?

Hello ! Dear HOA Legal Manager :
I m single home owner at Montage Community Livermore since 2009 bought new home here California.
We pay $186/ Mo HOA fee included landscaping & trees service .
There is nice 13 years old growing tree on front of our home with shading & green leaves we & our neighbors love it …even though it is little incline & had some roots to exposed around turf lawn around common area .
but HOA manager decided to remove this lovely tree this week …
Me & wife do not like to remove it …
and HOA manager sent me a letter said we had no right for trees service & remove decision by HOA policies …
I m not agree with them …..
Do we have homeowner ‘s right of discussion with HOA management, that how could we treat common area trees reasonable & respectful make our homeowner happy & enjoy landscaping view & cooler down the hot temperatures on summer times by California HOA policies on 2022–2023 ?

Hi Robert,

If the tree is in a common area, then your homeowners association has control over it. This means the HOA can remove it without consulting the homeowners. Additionally, your HOA might have wanted to remove the tree due to safety reasons as well as aesthetic reasons.
