Capital Improvement Without Approval in Ohio

Can the Board of an Ohio Condo Association purchase a large Capital Asset without the kownledge or approval by the Unit Owners

Hi Michael,

As per Section 5311.081 of the Ohio Condominium Law, an owners association, through its board of directors, may cause additional improvements to be made as part of the common elements. Acting within the best interest of the community, the board generally does not need to obtain membership approval for the purchase of capital assets or improvements. However, you should still check your governing documents to know for sure.
