Changing Board Meeting Time in Texas HOA

Question:

Can the Board change the HOA meeting without notifying or asking the owner?

For as long as I live at the Walnut Hill Condos (around 2015) the meeting has been in the evenings.

July 10, 2023 the meeting was weld around 2:00 pm.
Obviously, owner that hold a regular job are not all off from work before 2:00PM.

I do not recall being notified to vote on this matter.

Also, we do not get any notice of what the minutes. Can I ask that one be provided to the undersigned?

Answer:

Hi Maria-Elena,

First of all, it is important to check your bylaws. The association’s bylaws should indicate the frequency of board meetings and when they should take place. The board must follow these requirements.

Secondly, the board must provide a notice of the meeting to all owners. As per Section 209.0051 of the Texas Property Code, this notice must be given in one of two ways:

1. By mailing notice to the owners no less than 10 days and no more than 60 days before the meeting; or
2. By posting notice of the meeting in a common area of the property or on the property owners’ association’s website and e-mailing the owners at least 144 hours before a regular board meeting (or at least 72 hours before a special board meeting)

Notices must include the date, time, venue, and subject of the meeting. If it’s a meeting that is to be held over the phone, information on how to connect and listen must be provided in the notice.

The same section requires the board to make all meeting records, including approved minutes, available for member inspection and copying “on the member’s written request to the property owners’ association’s managing agent at the address appearing on the most recently filed management certificate or, if there is not a managing agent, to the board.”
