Collecting Dues But Not Doing Maintenance

Question:

Can a board continue to collect monthly assessments from homeowners even when general maintenance are not being completed?

– Darlene

Answer:

Hi Darlene,

Homeowners should not stop paying their dues as a form of retaliation if they believe that their HOA is not doing its job (such as completing maintenance tasks). If you wish to know where funds are going, it is best to review the HOA’s financial statements. These statements will let you know what the board is using collected dues for. Perhaps the funds have been re-allocated for the time being. If you have any complaints, make sure to approach your HOA board and let them know.
