Complaints About HOA Management Company

Question:

My HOA has a company that isn’t managing the HOA, which I don’t feel as being managed properly that aside if I file the complaint, and I feel like I am being threatened in harms way, and I have video of a neighbor being aggressive towards me. Do they not have a responsibility to investigate and do something? if so which I would imagine they do. How long do they have? Next I was told I’m not allowed to know anything because it was discussed during executive meeting which I think is a little bit of baloney because I’ve now having to get a restraining order and I’m just very very frustrated because I am talk texting right now , I’d very much like to have a verbal conversation

Answer:

Hi Holly,

It’s important to check your management contract and understand the scope of services agreed upon. It’s possible that the company is only responsible for a handful of tasks which do not include dispute resolution or addressing owner complaints. If it turns out that the company is not holding up their end of the contract, you should bring your complaint to your HOA board. Let the board know that the company isn’t doing its job.

As for topics discussed in the executive meeting, executive meetings are closed to homeowners. Board members are not required to open these meetings to other members, and discussions are kept confidential.

If you feel that your safety is at risk, it is best to report the issue to your HOA board and to local authorities.
