Complaints Against HOA Board in Virginia

Question:

I live in Ashburn Village and our HOA arbitrarily is changing charters when ever there are concern from homeowners. They make these changes outside of regular board meetings and do not publish in advance their intentions.

They have added a nominee for the BOD when clearly the deadline was missed. Publication of the candidates had to be submitted by August 8th so they could be published in The Villager. On the voting site there is an additional candidate.

I have many concerns as do my neighbors. Would it be possible to speak to someone?

Members of the HOA board must uphold their fiduciary duties and follow the provisions of both the law and the association’s governing documents. If you wish to file a complaint, you can do so with the Office of the Common Interest Community Ombudsman in Virginia.
