Complaints Against HOA Board in Washington

Question:

When there are definite conflicts of interests and double standards amongst HOA board members and management, versus owners, what legal entity deals with ethics violations, illegal conduct, and making these people accountable?

Is there a government entity that oversees HOA’s? Why don’t they pay people to be on the board (if standard’s in place such as sign contract to uphills ethical and legal obligations to community)?

Answer:

Hi Meghann,

Unfortunately, there is no separate entity that governs homeowners associations in Washington. If your HOA board is partaking in illegal conduct, it is important to report the case to local authorities. For housing discrimination cases, you may report the issue to the Washington State Human Rights Commission.

If you are unsatisfied with your HOA board, consider removing problematic board members. You can find guidelines for removal under Section 64.90.520 of the WASHINGTON UNIFORM COMMON INTEREST OWNERSHIP ACT, Section 64.38.025 of the WASHINGTON HOMEOWNERS’ ASSOCIATIONS ACT, and Section 64.34.308 of the WASHINGTON CONDOMINIUM ACT.
