Condo Association Not Providing Info on Assessments

Question:

I have asked the board and property manager for information on a recent assessment (3 times) over the course of 2 months. I have not had a response . The fees are due now. What is my recourse? I have every intention of paying but there must be condo law that states I am entitled to this information. I would like to put my condo fee and the assessement fee in an escrow account until I get the info. Is this legal? Do I need an attorney? THANK YOU

Hi Linda,

If the condo was formed before July 1, 1982, you may refer to the Rhode Island Condominium Ownership Act Section 34-36-20(c) which states that the HOA, upon written request of any unit owner, upon payment of a reasonable fee not to exceed ten dollars ($10.00), issue to a person so requesting a written statement setting forth the unpaid common expenses with respect to the unit covered by the request. Unless the request for a statement of indebtedness shall be complied with within ten (10) days, all unpaid common expenses which became due before the date of the request shall be subordinate to the lien held by the person requesting the statement.

If the condo was formed after July 1, 1982, the Rhode Island Condominium Act Section 34-36.1-3.18 states that all financial and other records shall be made reasonably available for examination within thirty (30) days of a request by any unit owner and his or her authorized agent.

In either case, you may raise these with the board and management company. Kindly exhaust all forms of communication and contact them by mail, email, text, and phone call. If possible, you may also visit them or raise the issue at a board meeting. For further guidance, kindly consult a lawyer.
