Condo Association Special Assessment in Pennsylvania

Hello,

I live in a Condo Apartment in Pennsylvania (Carnegie area)
Recently the property manager (PM) sent home owners a letter requesting a double monthly fee for three months to repair the crack of one of the buildings. In the letter PM stated that the insurance denied the claim ,so homeowners must pay for repair out of their pocket.
Our buildings are located in a mining subsidence area and the PM knew that but did not include this into the insurance policy.

I would like to know what option I have? I’m a retired man and this is big money for me. The PM was a pain in a a$$ for all of the homeowners for a couple of years and we could use some legal advice to help fight this person.

Hi Vlad,

Community members are required to pay special assessments. You may ask the property manager or the board if there are options they can give for a payment plan.

However, the Pennsylvania Uniform Condominium Act Section 3314(c)(2) does state that common expenses benefiting fewer than all the units shall be assessed exclusively against the units benefited, unless otherwise stated in the governing documents. Kindly check the governing documents to see whether these assessments are to be allocated to all unit owners. If not, and you will not benefit from the assessment, then you may raise this with the board. For further guidance, kindly consult a lawyer.
