Amending Bylaws to Align With State Laws

Question:

When the Texas Legislature changes or adds a law to the Texas Property Code, does an HOA (Property Association) need to add or change their By-laws too? or can the HOA not state anything and say that it is covered by Texas Law?

Answer:

Hi John,

If your governing documents conflict with state laws, state laws control and take precedence. In this case, it would be best to amend your governing documents to align with state laws. Make sure to consult an attorney, though, to see whether or not your documents really conflict with state laws. An attorney can also help you amend your documents to ensure compliance.
