Denial of Property Purchase in Minnesota HOA Based on Profession

Question:

I am looking at purchasing a detached townhome with a HOA, I am a licensed childcare provider, can they forbid me from purchasing in a development with a HOA. I have heard that a licensed daycare provider is a protected class, but I want to check into this before purchasing a new home.

Answer:

Hi Justine,

According to the Minnesota Human Rights Act Section 363A.09, they cannot refuse to sell real property based on race, color, creed, religion, national origin, sex, marital status, status with regard to public assistance, disability, sexual orientation, or familial status. Kindly verify whether your case falls under these categories. For further guidance, please consult a lawyer.
