Do City Laws Trump HOA Parking Restrictions?

Hello, I live in the Mountain High Community in Bend, Oregon. I would like to know if the City laws would override HOA Laws in let’s say parking enforcement? For example, HOA laws say you cannot park in your driveway. Would City law overrule HOA law if I wanted to fight this?

Hi Liz,

Unless city laws specifically prohibit HOAs from restricting driveway parking, an HOA generally has the power to restrict parking in driveways as long as this rule is in the governing documents. The city may permit you to park in your driveway. But if the HOA’s governing documents don’t allow it, then you cannot do so. Buying a house in an HOA community means agreeing to its rules and regulations, including parking restrictions.
