Do HOA Rule Amendments Require a Vote?

Question:

Our association will be revisiting the Rules & Regulations. There will be some changes to the original document. My question is – does the rewritten R&R’s need to be voted on by the residents?

Hi Risa,

It depends on your governing documents. Your documents should be able to tell you how the amendment process works. Typically, though, voting is only required for amendments to the CC&Rs/declaration. Operating rules usually only need the board’s vote. However, it is still best to check your governing documents and possibly seek advice from a lawyer.
