Does a Louisiana HOA Have to Have Open Board Meetings?

Question:

Our Homeowner’s Association was created by the filing of the subdivision, and members are defined as those who own lots in our subdivision.
Although our HOA bylaws are specific in how meetings of members are to be held and conducted, our bylaws are silent on who can attend Board of Directors Meetings.
In Louisiana, are the Board of Directors meetings open to members of the Association?

Answer:

Hi Glen,

Louisiana law currently does not address this. However, the state’s Open Meetings Law requires all public bodies to hold open meetings. While HOAs are not public bodies, the Open Meetings Law still provides a good framework for associations. And many HOAs, in Louisiana and elsewhere, do hold open board meetings. Opening your meetings, except executive sessions, to all owners will also promote transparency and trust. I suggest amending your bylaws to specifically address this issue, too.
