Enforcing a Lien on Passed Due Assessments

Question:

I have lived in my HOA for the past 20 years. I have always paid my dues. The HOA sends lien threats often because they want payment in full by Feb 1st OR half Feb. 1st and second half July 1st. Can they enforce a lien even when I don’t pay on their requested time line?

Answer:

Hi Tyrone,

It depends. Kindly review the governing documents to verify the deadline for assessments, how much is to be paid, and when the association is authorized to place a lien on the property. In many HOAs, unpaid assessments may lead to fees and constitute as a lien on the property if they are not paid when due. Thus, the HOA may have a right to enforce the lien if the governing documents allow. For further guidance, kindly consult a lawyer.
