Enforcing a Rule Not in the Governing Documents

Question:

Can an HOA in Arkansas force you to screen an outbuilding when it has not been enforced in the neighborhood and is not specifically written in the covenants or bylaws?

Answer:

Hi Lanette,

If your HOA board is enforcing a rule that isn’t in the governing documents, talk to them about it. Let them know that the rule does not exist in the CC&Rs or bylaws. If they insist, ask them to identify where the rule is written. Perhaps it is not an HOA rule but a local ordinance or a safety standard.
