Error in HOA Violation Letter Still Enforceable in Texas?

Question:

I was sent a fine for non compliance for reoccurrence of weeds in the expansion joints on my drive way. In the letter they didn’t site the correct CCR. They sited ccr 3.3 which basically says that before the house is done it should be sodded to the street. I looked at the CCRs myself and it should have sited ccr 3.15 which says that lot owners will at all times keep grass and weeds cut in a sanitary, healthful and attractive manner (pretty vague wording, in my opinion.) is this fine enforceable, even though the cited the wrong ccr statute on the violation paper work?

Yes, the HOA can still enforce the rule. However, you should talk to your HOA board about the error in the letter so they can correct it immediately.
