Examining Insurance Policies of an Ohio HOA

Question:

I own my condo. Recently experienced a leak in my bathroom. My insurance needed me to obtain a copy of the “associations” insurance policy. I contacted; however, was ignored and no response. When I had a mortgage my bank needed proof of insurance….the association provided….I had that information and contacted the company to see if a policy still existed….it does not….when I reached out to the association/realty company to see current proof of coverage….was ignored…..the last proof I have was 2020…..don’t know if they have been having coverage since then…..according to their monthly financial reports they’re showing payments made for “insurance”……but not willing to provide proof.

What can I do?

Hi Harvellia,

Since you are a board member, you should have access to the insurance policies of the association. While insurance policies are not part of the books and records that homeowners may examine (as outlined under the Ohio Planned Community Law and the Ohio Condominium Property Act), your governing documents may say otherwise. Make sure to review your CC&Rs and bylaws to understand the rights of the homeowners and the obligations of the HOA when it comes to records inspection requests. As a board member, though, you should be able to review your insurance policies and financial statements.
