Fee Increase and Notice in Georgia HOA

Question:

In Georgia, what is the percentage allowed in the increase of the HOA fees when there are no mentions within the Convenants and or by-laws and no shortage of reserve?

Also, can an HOA / Management increase and implement any HOA fees without giving prior notice and what would be the average days before implementing such increase if notice is given, taking into consideration that there are no mention of such in the convenants and or bylaws?

Hi Christian,

Georgia law does not currently dictate a maximum percentage allowed in the increase of HOA fees. Additionally, notice requirements will depend on your HOA’s governing documents. If this has yet to be addressed in your documents, it would be best to amend your documents to set a standard.
