Filing a Complaint Against HOA in New York

Question:

My HOA/Management Assoc. has not yet released the 2021-22, financial statements.

When we ask for them we get 2020-21 instead.

Who can we report them to?

Answer:

Hi Mary,

It is best to speak to your HOA board about this issue. As per Section 621 of the New York Not-For-Profit Corporation Law, any member of at least 6 months may examine the books and records of the corporation during usual business hours with a written request of at least 5 days prior. If your association is organized as a non-profit corporation, this should apply to you.

You may also try filing a complaint with the New York State Attorney General.
