Filing Complaints Against HOAs in South Carolina

Question:

How do I get HOA’s to fall under government regulations and/ or end the little moffia power play that gets misrepresented and a voluntary no paid BOD exploits their use of office?
Please send me all information

Also, how many resident signatures are needed to oust a Board President and Vice?

Answer:

Hi Carol,

If you are dissatisfied with the way your HOA board is running the community, you might consider removing them from their position. If your HOA is organized as a nonprofit corporation, Section 33-31-808 of the SC Nonprofit Corporation Act outlines the requirements and procedures for removing a board member. Your bylaws may also contain further information on how to remove board members from their position.

That said, you may also file a complaint against your HOA by heading to the South Carolina Department of Consumer Affairs. Here is their website where you can file complaints: https://consumer.sc.gov/consumer-resources/consumer-complaints
