Fined for Violation After 20 Years in Florida HOA

I need your advice. I have lived in my community since 1997. About a month ago I received a letter from my HOA saying that my trailer cannot be visible from the street and I was baffled. I called the HOA, talked to a young girl and explained to her that my trailer was behind an erected fence, and that possibly they had the wrong address. I told her my next-door neighbor had a truck & trailer out in front of his house for a few days as he buys and sells antiques in Estate sales. She told me not to worry about it. I just received a second letter and FINAL NOTICE with a threat of fines or legal action.

Back 25 years ago when we first moved in, the HOA sent us a letter and advised us that a trailer could not be visible from the street, and I asked what I could do to be in compliance?They told me to erect a fence at the end of the driveway & park it in the backyard behind the fence which I did, satisfied the HOA & end of story. So for 20 years I have not had an issue with this, and now, all of a sudden! help please!

Hi Kevin,

Talk to your HOA again. It is possible that there was another mix-up or that the HOA changed its policy at some point. Check your governing documents. They will shed some light on the issue regarding your trailer and fence. You are also entitled to a disciplinary hearing before the HOA levies a fine against you, as per the Florida HOA Act Section 720.305.
