Florida HOA Won’t Make Repairs

Question:

I have a situation with my association. The pool has never been fixed over 5 years. Tennis courts the same the only thing is the landscaping that is done from time to time not consistently. Right now I have a water damage and flooding in apartment that they have yet to answer me back or came to see.

Answer:

Hi Carl-Henri,

Your HOA might be having financial issues which are causing a delay in repairs and maintenance. That said, the HOA still has an obligation to maintain the common areas of the community. Some actions you can take include complaining to the HOA board or manager, removing one or more board members, or suing the HOA on various legal grounds (such as a breach of fiduciary duty or negligence). Make sure to first exhaust all communication channels when attempting to reach the board prior to considering legal action.
