Forced Membership in an HOA in California

Question:

Our executive committee wants all homeowner members to join another association. They want to take the money out of the association’s financial account for each member’s dues. My husband and I do not want to join the other association. Is it legal for them to force us to join the other association?

Answer:

Hi Judy,

It is unlikely that your HOA’s executive committee can legally force you to join another association against your will. HOAs are typically governed by specific bylaws, which provide the rules and regulations for the association’s operations. These bylaws may outline the requirements for membership in the HOA and any other affiliated associations that the HOA may have. However, it is generally not legal for the HOA to impose new membership requirements or financial obligations on its members without following the proper procedures outlined in its governing documents.

If you and your husband do not want to join the other association, you should review your HOA’s governing documents to determine whether there are any requirements that would apply to you. If there are no such requirements, you may want to raise your concerns with the executive committee and request that they respect your individual choice. If the committee continues to insist that you join the other association, you may want to seek legal advice from an attorney who specializes in HOA law.
