Forming an Association in California

Question:

I live in a nice mobile home park. One of the residents wants to start an HOA in the community. Is there a minimum % needed to form a group? Most are against forming an HOA. Many, like me, are retired people, limited $$$.

Answer:

Hi Vickie,

Kindly refer to the Davis-Stirling Common Interest Development Act Section 4200, which states that:

“a common interest development is created when a separate interest coupled with an interest with an interest in the common area or membership in the association is, or has been, conveyed, provided all of the following are recorded:

(a) A declaration.
(b) A condominium plan, if any exists.
(c) A final map or parcel map, if Division 2 (commencing with Section 66410) of Title 7 of the Government Code requires the recording of either a final map or parcel map for the common interest development.”

There may be no minimum percentage requirement. For further assistance, kindly consult a lawyer.
