Growing Cannabis in Oregon HOAs

Question:

Not seeing anything from Oregon lawmakers to guide HOA’s dealing with cannabis growing in backyards, smokers in yards stinking out the neighbors, etc. Our CC&R’s do not cover growing cannabis or smoking of any kind. Shall we define cannabis as an invasive species thus not allowed to grow in the yard? If you hear of any ideas we can use in Eugene Oregon, help, please.

Hi Calla,

It is worth noting that Oregon law allows for the growing of up to four cannabis plants per residence. That being said, your homeowners association can regulate the types of plants residents can grow, including cannabis. Make sure that your governing documents expressly prohibit or restrict them. If your governing documents currently do not include such provisions, consider amending them.
