Halfway House in HOA

Question:

We have 116 residential (3-4 bedroom) homes in our neighborhood HOA.
It is a possibility that one of the homes is going to be used as a “Halfway-house” for recovering drug addicts. How can this be prevented?

– Timothy

Answer:

Hi Timothy,

Both federal and state laws may prevent the HOA from banning these halfway houses as drug addicts may be protected according to the Fair Housing Act and federal courts. However, the residents within the halfway house may still need to follow the HOA’s rules.
