HOA Allowing Only Catholic Mass as Religious Celebration in Common Area

Question:

Can an all Catholic Board of Directors allow Catholic Mass as the only religious celebration in the common area and exclude all other denominations?

– James

Answer:

Hi James,

The Wisconsin Open Housing Law Section 106.50(2)(g) may apply, which states it is unlawful to discriminate in providing the privileges, services, or facilities that are available in connection with housing.

If you live in a condominium, the Wisconsin Condominium Ownership Act Section 703.14(1) may also apply, which states that the common elements may be used only for the purposes for which they were intended. Moreover, they are subject to the mutual rights of support, access, use, and enjoyment by all unit owners.

You may raise these with the HOA board. For further guidance, kindly consult a lawyer.
