HOA Board Member Removal in Oregon

Question:

Need information about removal of HOA board members that play favorites, discriminate towards those that want to discriminate

Answer:

Hi,

According to The Oregon Planned Community Act Section 94.640(6), unless the governing documents say otherwise, homeowners may remove a director at a meeting with a quorum with or without cause by a majority vote. Kindly review your governing documents to see whether there are provisions to the contrary.

Moreover, the section states that the director must have an opportunity to be heard before the vote. The vote to remove the board member must also be included in the meeting’s notice and agenda items. The director also remains in position until the vacancy is filled or a successor is elected.
