HOA Board Member With a Knife

Question:

We have a board member who carries a long knife on his waist in a shield. As far as I’ve read it is legal. The community wants the board to take him off the board. But they want to be anonymous and not participate in this. What are their rights as homeowners? What are my implications as board president? I am not threatened by it but apparently some people are. They don’t like that he wears it around the community. He says it is a religious right to wear it. They see him as “armed”

First, it’s important to check your governing documents. Some HOAs have rules that prohibit or restrict residents from carrying a weapon in common areas. You might also want to consult a lawyer for advice. California law also allows homeowners to remove a director through a secret ballot vote.
