hoa board vote for other person

Question:

My mom owns a condo as a secondary residence. She is elderly and cannot attend meetings. As her son who takes care of the condo (association is 8 units) she wants me to represent her at meetings, votes etc. She lives out of town.
Does the law allow for this if she writes and signs a letter giving the necessary permissions for myself to represent on her behalf?
Thank you for the help.
Sincerely,
David

Answer:

Hi David,

The state of Massachusetts does allow this. Its called voting by proxy. But you will need to refer to the HOA‘s CCR’s and or Bylaws to see if the HOA allows it.
