HOA Change and Membership

Question:

If HOA changes and you were never opted in or signed papers to be in but paid dues one time or you legally bound by their rules and required to pay ?

– Amy

Answer:

Hi Amy,

It depends on what the HOA change means. If it simply changed the members of the board or the management company, then you’re still part of the HOA. If the HOA simply changed its name, then all the members typically also remain the same, as they are still bound by the same governing documents. The existing governing documents are often amended to accommodate the name change. However, if the association has dissolved and there was a new voluntary HOA formed, they may need your consent to opt in as a member. For further guidance, kindly consult a lawyer.
