HOA Charging Dues Without Services in Virginia

Can the HOA charge assessments if there are no community services, an undeveloped common area with no plans for development, and are paying a management agency?

Hi Thomas,

In general, an HOA does have the authority to charge and collect dues from homeowners. As per Section 55.1-1826(A) of the Virginia Property Owners Association Act, an HOA board must make the association’s annual budget available to owners at the start of the fiscal year. This budget should tell you what your dues are for.

Additionally, you may request to examine all financial books and records of the association as per Section 55.1-1815 of the same Act. These financial records should reflect where the association’s money has been going.

If you are concerned about the lack of services and the undeveloped common area, it is important to raise this issue with your HOA board. Attend the next board meeting to find out if there are any updates.
