HOA Control Over Social Media Group

Question:

Our neighborhood has a WhatsApp Chat group with the name of our subdivision, which is the name of our HOA. On the WhatsApp, which has about 50 members, one person is being abusive and actually lying about the actions of another member. Our HOA is trying to distance themselves from that group. I have begged them to issue at least a statement about posting, such as some kind of disclaimer, but to no avail. Does an HOA have the power to do anything about situations such as this?

It’s a good idea for an HOA to have a social media policy for its official pages. This policy can cover the behavior of users who post, comment, and message on the page. However, it is difficult for an HOA to regulate a social media group that it did not officially create. Additionally, an HOA generally can’t control whether or not its residents choose to create or participate in a social media group outside of the official pages.
