HOA Election But No Vote in Colorado

Question:

Hi,
we held our annual election of Board members during our homeowners association annual HOA meeting in Feb. We had a quorum, in-person meeting. We went through the agenda, then held board elections. Nominations were verbally cast along with one proxy. However, we did NOT cast votes, verbally or by ballot. the ones who were nominated are now running the board.

How can/should we rectify this situation.

– Chris

Answer:

Hi Chris,

Normally, in an uncontested election, board members are elected through a vote by acclamation. This does not require the HOA to go through the usual election process, which involves casting ballots. An uncontested election is when the number of candidates running for the board is equal to or less than the number of open seats on the board. Perhaps that is what happened with your election.
