HOA Failing to Maintain the Community in Louisiana

Question:

My HOA is doing some very funny things whilst we are charged more and more for a property that is quickly falling into disarray. We a huge whole in our road, homes that have been tarped for years, property’s that the hoa made claims on that had no damage, missing money, they reported as having fixed a bunch of houses that are STILL damaged, the list goes on and on.
But where is the money? Millions we pay into this hoa, they make claim after claim and the “manager” is taking a 4% cut from every claim. We are charged assessment after assessment, our pool is falling apart. I’m so tired.

A guy blew himself up in his apartment and they knew he was threatening this but NEVER called the police. He blew himself up in his apartment.

I understand hurricanes have been bad, but this is nuts.

Answer:

Hi Stephanie,

You may request the association’s financial records to verify how the assessments are being used. If you live in a condominium, your HOA is subject to the Louisiana Condominium Act Section 1123.107 which states that the HOA is responsible for the upkeep of common areas. You may raise this with the HOA board and management company.

If the problem persists, you may also opt to propose to switch management companies or remove the problem board member(s) according to the provisions of the Louisiana Business Corporation Act Section 1-808 or the procedure outlined in your governing documents.
